State of Vermont Press Release April 01, 2003 Through the Agency's investigation, it was discovered that Emch illegally burned and buried trash and asphalt shingles on his property. The matter came to light as a result of a calls to the Sheldon Fire Department on several occasions, which then notified the Agency. Environmental Enforcement Officers Reginald Smith and Sean McVeigh investigated the incidents. After the investigation was completed, Emch was notified of the violations and agreed to settle the matter. The settlement was reduced to an assurance of discontinuance and was so ordered by the Environmental Court on March 21, 2003. In it, Emch agreed to clean up the burned and buried material and properly dispose of it at a certified facility. It was also agreed that a civil penalty of $1,200 will be paid to the State of Vermont for the violations.
