State of Vermont Press Release June 29, 2006 Through the Agency's investigation, it was discovered that in June of 2005 the LaCrosses pumped an overflowing manure holding pond into a field. The manure flowed into a freshly cleaned drainage ditch and then into Minister Brook before it discharged into Lake Willoughby. The matter came to light as a result of a citizen complaint that was investigated by Environmental Enforcement Officer Reg Smith. After the investigation was completed, the LaCrosses were notified of the violations and agreed to settle the matter. The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on June 20, 2006. In it, Roger & Judy LaCross agreed to institute a new manure management plan which the Agency must approve. It was also agreed that a civil penalty of $1,000 will be paid to the State of Vermont for the violations in addition to funding a $6,500 supplemental environmental project.
