James Lumbra

WATERBURY- Agency of Natural Resources Secretary Thomas Torti today announced that the Enforcement Division has formally settled an environmental violation involving James Lumbra who owns property in Randolph. The settlement includes a $5,200 penalty.

Through the Agency's investigation, it was discovered that Lumbra allowed the remains of a demolished building owned by the town of Randolph hauled to his property where it was dumped in a ravine and put in a large pile for later burning. Over 500 cubic yards of material were dumped on his property. This activity is prohibited under Vermont statute and Solid Waste Management rules.

The matter came to light as a result of a citizen complaint which was investigated by Environmental Enforcement Officer Patrick Nevers. After the investigation was completed, Lumbra was notified of the violations and agreed to settle the matter. He also removed all of the illegally disposed materials and properly disposed of it.

The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on June 5, 2006. In it, James Lumbra agreed to pay a civil penalty of $5,200 to the State of Vermont for the violations
