Through the Agency's investigation, it was discovered that A.B.L.E. Waste Management, Inc., in the course of doing business, did not have a permit for their sorting and storage facility. Once notified of this failure A.B.L.E. Waste Management, Inc. immediately removed all waste from the site and worked quickly to obtain the necessary certification.

The matter came to light as a result of a citizen complaint made to and investigated by the Solid Waste Management Program. After the investigation was completed, A.B.L.E. Waste Management, Inc. agreed to settle the matter.

The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on August 23, 2007. In it, A.B.L.E. Waste Management, Inc. agreed to resolve the violations by paying a $4,000 civil penalty to the State of Vermont and funding a $7,500 supplemental environmental project.
