T.A.M., Inc.

WATERBURY- Agency of Natural Resources Secretary George Crombie today announced that the Enforcement Division has formally settled an environmental violation involving T.A.M., Inc. The settlement includes an $8,500 penalty and an $8,500 supplemental environmental project.

Through the Agency's investigation, it was determined that T.A.M., Inc. disposed of 1445 tons of municipal solid waste at a certified unlined landfill owned by the Town of Shaftsbury during the period of July 25 - October 4, 2005. Additionally, review of the town's tonnage records revealed T.A.M., Inc. exceeded the daily tonnage limit during this time period. This disposal violated the town's certification and applicable law limiting the landfill to accept less than 1000 tons of municipal solid waste per year. The waste was disposed pursuant to a contract with the town. Further investigation revealed T.A.M., Inc. violated the landfill's certification and applicable law by failing to submit written notification to the Agency prior to disposal of 395 tons of out-of-town waste and failing to obtain a certificate to operate the landfill.

The matter came to light as a result of routine Agency oversight, which included a meeting between Agency and Shaftsbury town officials. After the investigation was completed, T.A.M., Inc. was notified of the violations and agreed to settle the matter.

The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on October 10, 2007. In it, T.A.M., Inc. agreed to comply with the facility's certification and applicable law in operating its business, and to submit written documentation to the Agency verifying that it has received a copy of the Certification and is familiar with its procedures, terms and conditions. It was also agreed that a civil penalty of $8,500 will be paid to the State of Vermont for the violations, which includes the recovery of economic benefit incurred as a result of the violations, and that an $8,500 supplemental environmental project will be funded.
