South Burlington School District

WATERBURY, Vt. - Agency of Natural Resources Secretary George Crombie today announced the Enforcement Division has formally settled an environmental violation involving the South Burlington School District. The settlement includes a $3,500 supplemental environmental project.

Through the Agency's investigation, it was discovered that an employee of the South Burlington School District disposed of a mixture of approximately 10-15 gallons of red latex field paint and water into a storm drain located in the South Burlington High School parking lot. The paint entered a small stream from the storm drain's outlet and then flowed into an adjacent wetland near Kennedy Drive. The matter came to light as a result of a complaint from the Agency of Transportation and South Burlington Public Works Department that was investigated by Environmental Enforcement Officer Gary Urich. The investigation revealed that this activity had been occurring for the past three years.

In response to the discharge, the school district placed absorbent booms in the stream, removed residual paint from the storm drains catch basin, and hired an environmental contractor to complete the cleanup. After completion of the investigation, the school district was notified of the violation and agreed to settle the matter. Prior to the initiation of the Agency's enforcement action, the school district labeled its field-lining equipment with instructions for disposal of field paint, labeled all storm drains on its high school property with no-dumping markings, and developed a paint-disposal procedure for its employees.

The settlement was reduced to an assurance of discontinuance and was so ordered by the Environmental Court on Feb. 12. In it, South Burlington School District agreed to refrain from disposing any material in its storm drains except stormwater as allowed under any applicable law or permit. It was also agreed that a $3,500 supplemental environmental project will be funded.
