State of Vermont Press Release May 05, 2008 Through the Agency's investigation, it was discovered that the Town, in the course of operating its transfer station, failed to submit a renewal application for a certification to operate the facility. In addition, an inspection of the facility revealed a number of operational violations of the previous certification and the Solid Waste Management Rules. These included quarterly and annual reporting; facility access control; management of crushed glass, used oil and recyclables; nuisance conditions from open burning; and failing to grade and cap its categorical disposal facility, or stump dump. The matter came to light as a result of routine Agency oversight and an inspection of the facility by the Department of Environmental Conservation's Waste Management Division. After completion of the investigation, the Town was notified of the violations and agreed to settle the matter. The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on April 30, 2008. In it, the Town of Shrewsbury agreed to complete closure of the categorical facility; comply with Agency directives and requests for information regarding the re-certification application and operational issues; and comply with the air pollution control regulations.
