State of Vermont Press Release May 01, 2008 Through a collaborative investigation, it was discovered that between March 29, 2007 and April 19, 2007, Michael A. Cyr disposed of 22 black plastic bags of asbestos shingles and one small trailer load of asphalt shingles at several roadside locations in Irasburg, Coventry, and Derby. The debris originated from a roofing job in Newport. The matter came to light as a result of a citizen complaint that was investigated by Agency Enforcement Officer Reg Smith along with personnel from the Fish & Wildlife Department and Orleans County Sheriff's Department. After the investigation was completed, Cyr was notified of the violations and in response cleaned up all except one of the disposal sites. Mr. Cyr subsequently agreed to settle the matter. The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on April 27, 2008. In it, Mr. Cyr agreed to properly dispose of the shingle debris from the remaining disposal site and comply with the Solid Waste Management Rules in the operation of his business. It was also agreed that a civil penalty of $2,000 will be paid to the State of Vermont for the violations.
