Through the Agency’s investigation, it was discovered that Codling Brothers Logging violated numerous acceptable management practices at one of its logging sites in East Montpelier.

The matter came to light as a result of a citizen complaint that was investigated by Environmental Enforcement Officer Sean McVeigh and a state forester. During the investigation, they observed that Codling had not installed sediment control measures on the site as required by the logging acceptable management practices. Coddling told the investigators that he had decided to use a Class II wetland located at the center of the site as a sediment trap. A large amount of sediment from the logging operation moved down a brook into the Class II wetland where it overflowed into another brook, all of which are state waters.

After the investigation was completed, Codling Brothers Logging was notified of the violations and agreed to settle the matter. Respondent had previously fully implemented the accepted management practices to prevent further discharges from the site.

The settlement was reduced to an assurance of discontinuance and was ordered by the Environmental Court. In it, Codling agreed that he and his company will fully comply with the accepted management practices on all future logging operations and will pay a $2,000 penalty to the state.
