J.K.L. Limited Partnership

Agency of Natural Resources Secretary Scott Johnstone today announced that the Enforcement Division has formally settled an environmental violation involving the construction of a building in Berlin by J.K.L. Limited Partnership, an Ohio based company. The settlement includes a $1,200 penalty and $3,000 supplemental environmental project.

Through the Agency's investigation, it was discovered that J.K.L. Limited Partnership, in the course of constructing the building, failed to comply with its Act 250 Land Permit when it did not employ adequate erosion controls and comply with energy efficient requirements. A resulting discharge to the Stevens Brook violated both the Permit and state law.

The matter came to light as a result of a citizen complaint that was investigated by Environmental Enforcement Officer Sean McVeigh. After the investigation was completed, J.K.L. Limited Partnership was notified of the violations and agreed to settle the matter. They also installed all the necessary erosion controls as required.

The settlement was reduced to an assurance of discontinuance and was so ordered by the Environmental Court on July 17, 2002. In it, J.K.L. Limited Partnership agreed to install energy upgrades on a second building on the site to make up for shortcomings in the already constructed building. It was also agreed that a civil penalty of $1,200 will be paid to the State of Vermont for the violations and that a $3,000 supplemental environmental project will be funded.
