Heritage Environmental Services, LLC

Agency of Natural Resources (ANR) Secretary Wibs McLain announced today that Heritage Environmental Services, LLC, a certified hazardous waste transporter and hazardous waste storage facility, has entered into a court-approved settlement concerning the company's failure to operate its Williston facility in accordance with the Vermont Hazardous Waste Rules and the facility's ANR Certification. The violations were discovered during inspections conducted by ANR Waste Management personnel in September, October and December of 2001.

In the settlement Heritage admits it committed the violations. The settlement requires the company to pay a $40,000 civil penalty, and to spend an additional $200,000 to fund supplemental environmental projects to protect or enhance the environment. Upon being notified of the violations the company took appropriate steps to bring the facility back into compliance.

The violations reflected in the court order include: failure to make a hazardous waste determination, failure to properly mark hazardous waste containers, failure to record Waste Stream Profiles (WSP) for waste stream analysis and keep records and results of all analyses performed in an operating log, failure to conduct chemical and physical analysis of waste samples, failure to maintain properly functioning instruments and approved sampling and analytical methods to properly conduct waste stream reviews.

"Hazardous waste violations such as these will not be tolerated in Vermont because they amount to a serious failure on the part of Heritage to properly identify wastes for treatment." ANR Secretary McLain commented. "The magnitude of the penalty in this matter appropriately reflects the seriousness of these violations." Secretary McLain added. "I am proud of the excellent investigative work of the Waste Management Division staff in uncovering these violations."
