G.D.E. Corp. dba Greaves Dairy Equipment

Agency of Natural Resources Secretary Elizabeth McLain today announced that the Enforcement Division has formally settled an environmental violation involving G.D.E. Corporation dba Greaves Dairy Equipment. This company is located in Greensboro Bend and is engaged in the business of sales, installation, and service of agricultural and related equipment. The settlement includes a $1,300 penalty.

Through the Agency's investigation, it was discovered that Greaves Dairy Equipment, in the course of doing business, sold an outdoor wood-fired boiler, or waterstove, to a customer without providing written notice to the customer of air pollution control's waterstove regulation. This regulation contains setback and stack height requirements, and the waterstove was subsequently installed in violation of the requirements.                                                                     .

The matter came to light as a result of citizen complaints about the smoke. After the investigation was completed, G.D.E. Corporation dba Greaves Dairy Equipment was notified of the violations and agreed to settle the matter. The investigation also revealed that Greaves Dairy Equipment was aware of the regulations and that the location of the waterstove did not comply with the setback requirement. The purchaser had alternate heating sources and agreed to disconnect the waterstove.

The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on December 5, 2003. In it, G.D.E. Corporation dba Greaves Dairy Equipment agreed to provide the required notice of the regulation to its customers. It was also agreed that a civil penalty of $1,300 will be paid to the State of Vermont for the violations.
