Capital City Press, Inc. operates a printing and book binding facility in Berlin, Vermont. In the course of doing business, the company generates hazardous waste that includes used oil, oily solids, waste ink, developer/film processor waste, and washing solution. A routine compliance evaluation inspection conducted at the facility in February 2004 revealed that the company failed to make hazardous waste determinations for waste ink, have an up-to-date contingency plan, maintain a hazardous waste inventory log and conduct daily inspections for a storage area, post warning signs, and properly label hazardous waste storage containers in violation of the Vermont Hazardous Waste Management Regulations.

After the investigation was completed, Capital City Press, Inc. was notified of the violations and agreed to settle the matter. The company also took appropriate steps to come into compliance with the Vermont Hazardous Waste Management Regulations.

The settlement was reduced to an assurance of discontinuance and was so ordered by the Environmental Court on June 22, 2004. In it, Capital City Press, Inc. agreed that a $4,500 supplemental environmental project will be funded.
