State of Vermont Press Release November 19, 2004 Through the Agency's investigation, it was discovered that Riverside Horse Farm, LLC, in the course of refurbishing a number of buildings, illegally burned construction and demolition waste and horse bedding material. The matter came to light as a result of citizen complaints which were investigated by Environmental Enforcement Officer Patrick Nevers. After the initial investigation and warning, Nevers continued to receive complaints, and a subsequent investigation revealed that additional burning had taken place. Enforcement action was then initiated and Riverside Horse Farm, LLC agreed to settle the matter. The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on November 17, 2004. In it, Riverside Horse Farm, LLC agreed to remove all illegally burned material, dispose of it in accordance with solid waste management regulations, and comply with state regulations in the future. It was also agreed that a civil penalty of $1,500 will be paid to the State of Vermont for the violations.
