Through the Agency's investigation, it was discovered that one of two 275-gallon above ground storage tanks at the rental unit tipped over and released between 36-160 gallons of kerosene to the environment. Moore should have reported the release to the Agency and also ignored the discharge, both violations of state law.

The matter came to light as a result of a citizen complaint originally reported to the town health officer. The complaint was investigated by Environmental Enforcement Officer Sean McVeigh. After McVeigh's investigation was completed, Moore was notified of the violations and agreed to settle the matter.

An Administrative Order was issued and over 100 tons of soil were removed from the site before it was considered to be remediated. The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on December 29, 2004. In it, Bradford Moore agreed to pay a civil penalty of $3,250 to the State of Vermont for the violations.
