Chimney Hill Owners Association, Inc.

WATERBURY -- Agency of Natural Resources Secretary Thomas Torti today announced that the Enforcement Division has formally settled an environmental violation involving Chimney Hill Owners Association, Inc. in Wilmington. This respondent owns and operates a community water system that serves over 500 connections. The settlement includes a $5,000 penalty and a $10,000 supplemental environmental project.

Through the Agency's investigation, it was discovered that an employee of the Chimney Hill Owners Association was improperly taking water samples for testing. As part of running the system the operator was to obtain monthly samples from 5 locations, however he was only taking the sample from a single location. The matter came to light as a result of a citizen complaint that was investigated by Environmental Enforcement Officer Tim McNamara.

After EEO McNamara's investigation was completed, Chimney Hill Owners Association was notified of the violations, agreed to settle the matter, and made extensive operational changes to correct the problem, including terminating the employee. It has also demonstrated that it is taking the violations very seriously and has taken appropriate steps to insure that the violation is not repeated.

The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on June 9, 2005. In it, Chimney Hill Owners Association, Inc. agreed to disconnect one water supply source in an approved manner and draft an article describing its experience regarding the violation and the ensuing enforcement action. It was also agreed that a civil penalty of $5,000 will be paid to the State of Vermont for the violations and that a $10,000 supplemental environmental project will be funded.
