Through the Agency's investigation, it was discovered that Intervale Condominium Owner's Association, in the course of doing business, failed to submit monthly chemical and groundwater monitoring reports in a timely manner, in accordance with the permit conditions, a previous Administrative Order, and two Assurance of Discontinuances.

The matter came to light as a result of the Agency's routine regulatory review. After the investigation was completed, Intervale Condominium Owner's Association, Inc. was notified of the violations and agreed to settle the matter.

The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on June 21, 2005. In it, Intervale Condominium Owner's Association agreed to comply with the applicable permits, regulations, and Assurances. It was also agreed that a civil penalty of $2,000 will be paid to the State of Vermont for the violations.
