State of Vermont Press Release May 17, 2006 Through the Agency's investigation, it was discovered that Midway Oil Corporation, in the course of doing business, violated numerous hazardous waste management regulations. Specifically it transported small quantity generator amounts of hazardous waste to the warehouse without a permit, and stored solid waste for greater than 90 days at the warehouse. It also failed to implement required response measures, maintain an employee hazardous waste management program, and properly manage hazardous waste within the warehouse. The matter came to light as a result of an Agency compliance inspection. After the investigation was completed, Midway Oil Corporation was notified of the violations and agreed to settle the matter. It also has terminated its use of the warehouse for storage of hazardous waste and properly disposed of the waste that was on site. The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on May 9, 2006. In it, Midway Oil Corporation agreed to comply with all applicable environmental laws and regulations in the operation of its business. It was also agreed that a $14,500 supplemental environmental project will be funded. Involved Program: Hazardous Materials, Waste Management Division of the Department of Environmental Conservation |
