Through its investigation, the Agency discovered that the Town of Bennington's wastewater treatment facility violated its discharge permit when staff lost bench sheets and laboratory reports for 1999 and 2000. Bench sheets provide the analysis of influent and effluent results for various bacteria and form the basis for test results submitted to the state's Wastewater Management Division.

The matter came to light as a result of the Agency's routine compliance evaluation inspection. After the investigation was completed, the Town of Bennington was notified of the violations and agreed to settle the matter.

The settlement was reduced to an assurance of discontinuance and was so ordered by the Environmental Court on February 8. In it, the town agreed to fund a $2,000 supplemental environmental project.
