In August of 2001, in response to a citizen complaint, Environmental Enforcement Officer Don Gallus discovered that the Town of Rupert's road crew had channeled and excavated approximately 100 yards of stream bed and placed concrete barriers across the White Creek, in violation of state law.

After the investigation was completed, the Town of Rupert was notified of the violations and agreed to settle the matter. The settlement was reduced to an assurance of discontinuance and was so ordered by the Environmental Court on January 8, 2002. In it, the Town of Rupert agreed to design and implement work procedures for town employees and fund a $3,000 supplemental environmental project.
