State of Vermont August 01, 2006 Through the Agency's investigation, it was discovered that Handy's Service Stations, Inc., in the course of doing business at Handy's Texaco in Burlington, failed to properly monitor an underground storage tank, failed to have an automatic leak detector in the pressurized piping, and failed to conduct release detection. The matter came to light as a result of a routine agency inspection. After the investigation was completed, Handy's Service Stations, Inc. was notified of the violations. Initially Handy's Service Stations refused to settle the violations and an Administrative Order was filed in the Environmental Court. After the filing of that Administrative Order Handy's Service Stations agreed to settle the matter. The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on July 18, 2006. In it, Handy's Service Stations agreed to take all necessary corrective action at the station. It was also agreed that an $8,000 penalty will be paid to the State of Vermont for the violations.
