Through the Agency's investigation, it was discovered that Abeyta obtained a permit to heavy-cut 40 acres. However, 51 acres was heavy-cut, which exceeded his permitted limit.
The matter came to light as a result of citizen complaints that were investigated by Forests Parks and Recreation. After the investigation was completed, Abeyta was notified of the violations and agreed to settle the matter.
The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on December 3, 2007. In it, Abeyta agreed to conditions and to pay a $4,825 civil penalty to the State of Vermont for the violations.
