Champlain Oil Co., Inc.

WATERBURY- Agency of Natural Resources Secretary George Crombie today announced that the Enforcement Division has formally settled an environmental violation involving Champlain Oil Co., Inc. The settlement includes a $10,000 penalty.

Through the Agency's investigation, it was discovered that Champlain Oil Company, Inc., in the course of doing business, failed to document, conduct and report underground tank storage leak detection at a number of its facilities in 2006 and 2007. Many of these were repeat violations, which came to light as a result of routine compliance inspections by the Underground Storage Tank Program of the Waste Management Division.

After the investigation was completed, Champlain Oil Co. was notified of the violations and agreed to settle the matter.

The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on June 25. In it, Champlain Oil agreed to implement a plan, approved by the Agency, to ensure that proper leak detection documentation and response to leak detection alarms are conducted at each facility. It was also agreed that a civil penalty of $10,000 will be paid to the state of Vermont for the violations.
