Magic Hat Brewing Co. & PurposeEnergy, Inc.
From December 2010 through June 2011 the companies exceed the daily maximum effluent flow limit of the pretreatment discharge permit multiple times. The companies also exceeded the permit’s monthly average effluent limit for Biochemical Oxygen Demand (BOD) in December 2010 and in January, February, April, and June 2011.
The matter came to light as a result of routine Agency oversight. After the companies were notified of the violations they agreed to settle the matter. The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court. In it, Independent Brewers United Corporation d/b/a Magic Hat Brewing Company and PurposeEnergy, Inc. agreed to comply with its pretreatment discharge permit and any other applicable permit and environmental law, in the operation, maintenance, and testing of its wastewater pretreatment facility. It was also agreed that they will pay a civil penalty of $2,500.00 to the State of Vermont and contribute $7,500.00 to a Supplement Environmental Project for the violations.
