Through the Agency's investigation, it was discovered that Dean and Anne Salvas built an access road across a Class II wetland. This road was built to provide access to a gravel pit on the site and was done before their pending applications for a Land Use Permit and Conditional Use Determination were issued.

The matter came to light as a result of a citizen complaint that was investigated by Environmental Enforcement Officer Sean McVeigh. After the investigation was completed, the Salvases were notified of the violations and agreed to settle the matter.

The settlement was reduced to an assurance of discontinuance and was so ordered by the Environmental Court on May 1, 2003. In it, Dean and Anne Salvas agreed to come into compliance with their permits and the applicable state regulations. It was also agreed that a $5,000 supplemental environmental project will be funded.
