State of Vermont June 05, 2003 Through the Agency's investigation, it was discovered that the Sundown Corporation, in the course of doing business, failed to provide any erosion controls when it cleared and contoured a house site in Stowe. The site then sat without further development for over a year, resulting in significant erosion that discharged to state waters. The matter came to light as a result of an anonymous citizen complaint and was investigated by Environmental Enforcement Officer Sean McVeigh. After the investigation was completed, Sundown Corporation was notified of the violations, took immediate action to make the necessary corrections, and agreed to settle the matter. The settlement was reduced to an assurance of discontinuance and was so ordered by the Environmental Court on May 21, 2003. In it, the Sundown Corporation agreed to comply with the state regulations and pay a civil penalty of $10,000 to the State of Vermont for the violations.
