Through the Agency's investigation, it was discovered that Casella Waste Management Inc., in the course of doing business, exceeded its daily tonnage limit, failed to remove waste from the tipping floor each day as required by its permit, and failed to report its non-compliance.

The matter came to light as a result of a site inspection conducted by the Agency. After the investigation was completed, Casella Waste Management Inc. was notified of the violations and agreed to settle the matter.

The settlement was reduced to an assurance of discontinuance and was so ordered by the Environmental Court on September 10, 2003. In it, Casella Waste Management Inc. admitted the violations and has subsequently implemented company wide procedures to prevent a reoccurrence at any of its facilities. It was also agreed that a civil penalty of $10,600 will be paid to the State of Vermont for the violations.
