Through the Agency's investigation, it was discovered that the Cavendish Wastewater Treatment Facility failed to meet certain conditions of its Discharge Permit when it did not submit an electrical power failure plan as required and had not submitted several self-monitoring reports by their due dates.

The matter came to light as a result of the Agency's regulatory oversight. After the investigation was completed, the Town of Cavendish was notified of the violations and, when they did not comply, an Administrative Order was issued. The Town subsequently agreed to settle the matter.

The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on November 5, 2003. In it, the Town of Cavendish agreed to submit an approvable power failure plan as required by the Discharge Permit. It was also agreed that an $8,750 supplemental environmental project will be funded.
