R.R. Charlebois, Inc.

Agency of Natural Resources Secretary Elizabeth McLain announced today that the Enforcement Division has formally settled an environmental violation involving R.R. Charlebois, Inc. R.R. Charlebois is a commercial enterprise in Colchester that sells and services trucks. The settlement includes a $7,500 penalty and $7,500 supplemental environmental project.

Through the Agency's investigation, it was discovered that R.R. Charlebois, Inc., in the course of doing business, paved an area located within a 50-foot buffer zone of a Class II Wetland. It did this without obtaining a Conditional Use Determination, which is a violation of state environmental law. It also constructed a maintenance building without obtaining an Act 250 permit.

The matter came to light when the Town of Colchester requested that the Agency perform a site visit. After the investigation was completed, R.R. Charlebois was notified of the violations and agreed to settle the matter.

The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on April 22, 2004. In it, R.R. Charlebois, Inc. agreed to and has taken necessary steps to restore the site and has obtained the necessary permits. It was also agreed that a civil penalty of $7,500 will be paid to the State of Vermont for the violations and $7,500 will be contributed to a supplemental environmental project.
