Through the Agency's investigation, it was discovered that the Town of Bristol, in the course of doing business failed to sufficiently cover its landfill in violation of its certification in effect at the time. As a result, litter was blown around and off of the landfill.

The matter came to light as a result of two routine, Agency inspections. After the investigation was completed, the Town of Bristol was notified of the violations and agreed to settle the matter.

The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on June 4, 2004. In it, the Town of Bristol agreed to come into compliance with its landfill certification. It was also agreed that a $5,000 supplemental environmental project which focuses on the stabilization of a public trail will be administered by the Watershed Center located in Bristol.
