Fred's Plumbing & Heating, Inc. dba Fred's Heating Oil Co.

WATERBURY- Agency of Natural Resources Secretary Thomas Torti today announced that the Enforcement Division has formally settled an environmental violation involving Fred's Plumbing & Heating, Inc. dba Fred's Heating Oil Co. This company operates a fuel oil delivery service in the Northeast Kingdom. The settlement includes a $5,250.00 penalty.

Through the Agency's investigation, it was discovered that Fred's Heating Oil Co., in the course of doing business, delivered fuel oil to an unpermitted 1,000 gallon diesel fuel underground storage tank at the Charleston Town Garage. A release from the tank was discovered in April of this year and discharged into a tributary of the Clyde River.

The matter came to light as a result of notification of a possible leaking underground storage tank to the Spill Program in the Waste Management Division. It was investigated by Environmental Enforcement Officer Reginald Smith. After his investigation was completed, Fred's Heating Oil Co. was notified of the violations and agreed to settle the matter.

The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on November 30, 2005. In it, Fred's Heating Oil Co. agreed to comply with all environmental laws and regulations in the conduct of its business. It was also agreed that a civil penalty of $5,250.00 will be paid to the State of Vermont for the violations.
