The town of Shelburne operates the Crown Road Wastewater Treatment Facility. This facility has a permit to discharge treated effluent into Lake Champlain in accordance with specified conditions. Through the Agency's investigation, it was discovered that the facility's discharges exceeded these permit limits, resulting in numerous significant violations.

The matter came to light as a result of routine, agency oversight. After the investigation was completed, the town of Shelburne was notified of the violations and agreed to settle the matter. Also, it subsequently installed equipment to prevent these discharges from reoccurring.

The settlement was reduced to an assurance of discontinuance and was so ordered by the Environmental Court on January 27, 2003. In it, the town of Shelburne agreed to comply with the applicable state regulations and fund a $13,500 supplemental environmental project.
