Through the Agency's investigation, it was discovered that in 2002, George Huntington learned from his fuel delivery service that the apartment building's underground storage tank was leaking fuel oil. He acted promptly to excavate and remove the tank; however he failed to notify the Agency of the release.

The matter came to light several weeks later when Mr. Huntington's tenant notified the Agency. The matter was investigated by Environmental Enforcement Officer Gary Urich. After his investigation was completed, Mr. Huntington was notified of the violations and agreed to settle the matter.

The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on October 17, 2006. In it, Mr. Huntington agreed to pay a civil penalty of
$4,000 to the State of Vermont for the violations.
