Through the Agency's investigation, it was discovered that Evans Group, Inc. had two, unreported fuel releases over a six-month period. One was at a gas station in Fairlee and one at a gas station Sharon. Both sites were cleaned up by the company.

Both matters came to light after representatives of Evans Group, Inc. reported them, but not in a timely or correct manner as required. After the investigation was completed, Evans Group, Inc. was notified of the violations and agreed to settle the matters. This company has had similar violations in the past.

The settlement was reduced to an assurance of discontinuance and was so ordered by the Environmental Court on August 6. In it, Evans Group, Inc. agreed to take specific steps to better educate its employees about spills and how to respond to them appropriately. It was also agreed that a civil penalty of $6,000 will be paid to the state of Vermont for the violations.
