Through the agency's investigation, it was discovered that the Martins' constructed or modified six structures at various times from the early 1990s through 2006 without first obtaining water supply and wastewater permits. In addition, at one location the constructed water supply system was inadequately isolated from an adjoining wastewater disposal system. To bring the structures into compliance the Martins have spent $78,000 and have secured additional funding of $200,000 to complete needed construction.

The matter came to light as a result of an investigation conducted by Environmental Enforcement Officer Sean McVeigh. The agency filed four administrative orders for the properties involved and the Martins have now agreed to settle the matter. The Martins have hired an engineer, who is working with the Department's regional office in developing approvable water and wastewater systems for the properties.

The settlement was reduced to an assurance of discontinuance and the terms of the settlement have been approved by the Environmental Court. In the settlement Frederick and Sally Martin agreed to submit water and wastewater permit applications and complete construction of the approved systems by the end of this year. They also agreed to pay a $52,500 civil penalty to the state of Vermont for the violations.
