Through the agency’s investigation, it was determined that LTD & Sons Property Maintenance demolished a mobile home in Windham and began burning the debris, which consisted of bed springs, fiberglass insulation, plywood, plastic material, interior wall paneling, aluminum siding and roofing. Local fire departments responded while the fire was in progress and extinguished it.

Following the incident, Environmental Enforcement Officer Tim McNamara responded to investigate. As part of the investigation McNamara met with Deconinck at his property in Jamaica. During the visit he observed a debris pile containing partially burned and smoldering material along with brush and stumps. The material included plywood, plastic, insulation and remnants of fiberglass roofing that originated from the Windham site and another demolition job.

In response to agency directives, Deconinck properly disposed of the remaining material from both property sites. After completing the investigation, the Compliance and Enforcement Division notified Deconinck of the violations and he agreed to settle the matter.

The settlement was reduced to an assurance of discontinuance and was so ordered by the Environmental Court. In it, Deconinck agreed to comply with the air pollution control regulations in the operation of his business. He was also agreed that a civil penalty of $4,800 will be paid to the state of Vermont for the violations.
