Town of St. Albans

WATERBURY – The Department of Environmental Conservation’s Compliance and Enforcement Division today announced that it has formally settled environmental violations involving the town of St. Albans.

The town owns and operates a wastewater collection system, which includes a pump station located adjacent to an industrial park. The settlement includes a $7,500 supplemental environmental project.

In November 2006, an overflow occurred at the pump station, causing between 1,000 and 1,500 gallons of untreated wastewater to discharge to Rugg Brook. In July 2007, another overflow of untreated wastewater occurred at the pump station, causing an unknown amount of untreated wastewater to discharge to Rugg Brook.

In the first instance, the station’s primary pump malfunctioned and the secondary pump failed to activate. In the second instance, the primary pump malfunctioned and the secondary pump had been inoperable and out of service for approximately five weeks. In each instance, the town temporarily repaired and placed a pump back in operation to cease the discharges, and subsequently repaired the other pump.

In August 2007, Agency personnel conducted a follow-up inspection of the pump station and determined the secondary pump was again inoperable. The town subsequently completed repairs according to a timeline set forth by the Agency, and provided an engineering certification that the pump station was operating properly.

The matter came to light as a result of the town self-reporting the incidents and through follow-up inspections by the Agency’s Wastewater Management Division. After the inspections were completed, the town was notified of the violations and agreed to settle the matter.

The settlement was reduced to an assurance of discontinuance and was so ordered by the Environmental Court. In it, the town agreed to develop and submit an operation, management and emergency response plan, maintain its pump stations and collection system in good working order, and comply with all applicable environmental laws in the operation, maintenance, and testing of its pump stations and collection system. It was also agreed that it will fund a $7,500 supplemental environmental project.
