Village of Alburg

WATERBURY – The Department of Environmental Conservation’s Compliance and Enforcement Division today announced that it has formally settled environmental violations involving the village of Alburg. The village owns and operates a wastewater treatment facility, which is subject to an agency discharge permit. The settlement includes a $5,800 supplemental environmental project.

Through agency compliance inspections, it was discovered that the village failed to comply with record-keeping, monitoring, and reporting provisions of its discharge permit by failing to complete weekly calibration checks on its influent flow meter, submit timely monthly self-monitoring reports to the agency, and retain influent flow meter charts and bench sheets for analyses performed on-site for a minimum of three years. It also failed to complete required monitoring for pesticides and constituents, and failed to submit phosphorous, sludge depth, and pesticide monitoring reports within permit timelines.

The matter came to light as a result of routine agency inspections. After the inspections were completed, the village of Alburg was notified of the violations and agreed to resolve the matter.

The settlement was reduced to an assurance of discontinuance and was so ordered by the Environmental Court. In it, the village of Alburg agreed to retain all records and information resulting from monitoring activities required by its discharge permit for a minimum of five years, submit any records and information to the agency upon request, and otherwise comply with its discharge permit, as well as with all other environmental permits and conditions applicable in the operation of the facility. It was also agreed that the village of Alburg will fund a $5,800 supplemental environmental project for the violations.
