State of Vermont Press Release December 15, 2003 In the course of doing business and during routine maintenance activities, Agway Energy Products, LLC generates waste that includes solvent-contaminated wastes and oily absorbents. These materials are identified as hazardous wastes. During routine compliance evaluation inspections of the facilities, it was discovered that there were violations of proper handling and storage requirements as required by state law. After the investigation was completed, Agway Energy Products, LLC was notified of the violations and cooperated in the settlement of the matter. The company took immediate steps to come into compliance with regulations regarding the storage and handling of hazardous wastes, as well as to reduce the amount of waste generated by the company's Vermont facilities. The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on December 5, 2003. In it, Agway Energy Products, LLC agreed to come into compliance with the applicable regulations. It also agreed to fund a $12,500 supplemental environmental project.
