State of Vermont Press Release July 20, 2004 Through the Agency's investigation, it was discovered that Joseph Cicia burned prohibited solid waste, including trash and construction debris, outside his home. He continued to do so repeatedly despite the Agency telling him to stop and after several notices of alleged violations were issued. The matter came to light as a result of several citizen complaints regarding the burning activities on the property. Environmental Enforcement Officer Reginald Smith performed the investigation and when it was completed, Joseph Cicia was notified of the violations and agreed to settle the matter. The settlement was reduced to an Assurance of Discontinuance and was so ordered by the Environmental Court on July 14, 2004. In it, Joseph Cicia agreed to the immediate cessation of all open burning on the property for two years. This includes illegal and legal materials. It was also agreed that a civil penalty of $1,125 will be paid to the State of Vermont for the violations.
