The incident occurred on July 26, 2005 when the tank from which chlorine was being drawn to disinfect the City's wastewater ran dry. As a result approximately 900,000 gallons of wastewater was discharged without disinfection. The City had chlorine in several other tanks at the facility, but the operator failure to switch to another tank resulting in the disinfection failure.

As part of the settlement the Secretary required that an independent consultant review operations at all the City's wastewater facilities. That independent review has been completed and the consultant's report has been submitted to the Wastewater Management Division for evaluation.
